1. Introduction

Chera TV, Inc. ("Company" or "we" or "us") respects your privacy and is committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit the Company's website located at www.CheraTV.com (the "Website"), use our mobile application (the "App"), or use any of our related services (collectively the "Services") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • Through our Services.
  • In email, text, and other electronic messages between you and us.
  • Through desktop applications you download from these Services, which provide dedicated non-browser-based interaction between you and the Services.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Services, unless such third party is acting as a service provider on our behalf.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using our Services, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

2. Children's Privacy

Our Services are not intended for or directed to children under 13 years of age without verifiable parental consent. In compliance with the Children's Online Privacy Protection Act ("COPPA"), we do not knowingly collect personal information from children under 13 unless we have obtained consent from their parent or legal guardian.

If you are under 13 years of age, you are not permitted to use the Services or provide us with any personal information without your parent's or guardian's consent.

If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will promptly delete that information. If you are a parent or guardian and believe we might have any information from or about your child under 13 without your consent, please contact us at privacy@cheratv.com.

For users between the ages of 13 and 18, our Terms of Service require that they may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by our Terms of Service on the minor's behalf.

3. Information We Collect Through Our Mobile App

In addition to the information described elsewhere in this policy, when you use our App, we automatically collect certain information related to your mobile device and your use of the App. This is essential for the App to function correctly, to improve your experience, and for the purposes described in the "How We Use Your Information" section. This information includes:

  • Device and Hardware Information: We collect your device model, operating system version (e.g., iOS 17, Android 14), screen resolution, device language, mobile network carrier, and time zone setting. This helps us optimize the App for your device and troubleshoot technical issues.
  • Unique Device Identifiers: We collect advertising identifiers such as Apple's Identifier for Advertisers ("IDFA") and Google's Advertising ID ("GAID"), as well as other vendor or app-specific identifiers. These are used for analytics, personalizing your experience, and, where you have provided consent, for measuring the effectiveness of our advertising campaigns. Under laws like GDPR and CPRA, these identifiers are considered personal information.
  • App Usage and Performance Data: We collect information about how you interact with our App, including the features you use, the buttons you tap, session duration, app launch times, crash logs, and performance data (e.g., latency). This helps us identify bugs, improve app stability, and understand which features are most valuable to our users.
  • Streaming and Content Consumption Data: We collect data related to your streaming activity, including the titles you watch, your viewing history, the duration for which you watch content ("watch time"), content you rate or add to a watchlist, and your search queries within the App. This data is critical for providing core features like "Continue Watching," personalizing content recommendations, and calculating royalty payments to our content partners. This information may be subject to the Video Privacy Protection Act ("VPPA"), and we handle it in accordance with applicable law.
  • Push Notification Tokens: If you opt-in to receive push notifications, we collect a unique token generated by your device's operating system. This token is used solely to deliver notifications to your device. You can manage your notification preferences at any time in your device settings.

4. Personal Information We Collect About You

We may collect and use the following personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household:

5. How Your Personal Information is Collected

We collect most of this personal information directly from you or via our Services. However, we may also collect information:

  • Directly from you when you register for an account, create a profile, fill out forms, or communicate with us;
  • From publicly accessible sources;
  • Directly from a third party (e.g., our business partners or social media platforms if you use social login);
  • From a third party with your consent;
  • Automatically as you navigate our Services, using technologies like cookies on our Website and SDKs in our App (see "Automatic Data Collection Technologies" and "Third-Party Service" section below);
  • Via our IT systems, including automated data collection technologies of our websites and other technical systems, such as our computer networks and connections, communications systems, email and instant messaging systems;
  • Information that you provide by filling in forms on our Services, including information provided at the time of registering to use our Services, subscribing to our Services, posting material, or requesting further services;
  • Records and copies of your correspondence (including email addresses), if you contact us;
  • Your responses to surveys that we might ask you to complete for research purposes;
  • Details of transactions you carry out through our Services and of the fulfillment of your orders; and
  • Your search queries on the Services.

You also may provide information to be published or displayed on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use of the Services.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

The technologies we use on our Website for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Services.
  • Web Beacons. Pages of our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics.
  • Flash Cookies. Certain features of our Services may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Services.

The technologies we use in our App for automatic data collection are primarily Software Development Kits (SDKs) provided by our third-party partners. See the "Third-Party Services and Use of SDKs" section below for more details.

6. Third-Party Services and Use of SDKs

Some content or applications, including advertisements, on the Services are served by third-parties. These third parties may use cookies, SDKs, or other tracking technologies to collect information about you when you use our Services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

To support the features and functionality of our Services, we use services and SDKs from various third-party partners. The use of these third-party services may involve the collection and sharing of your personal information. Below are the categories of third-party services we use:

7. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Services and its contents to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account and/or subscription, including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Services or any products or services we offer or provide though it.
  • To allow you to participate in interactive features on our Services.
  • To personalize your experience on the Services, such as by recommending content we think you will enjoy.
  • To operate, develop, provide, and promote the Services, which may include using your User Contributions in marketing and promotional materials, consistent with the license you grant us in our Terms of Service.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

8. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.
  • To third parties to market their products or services to you if you have not opted out of these disclosures.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Service and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Chera TV, Inc., our customers, or others.

9. How Long Your Personal Information Will Be Kept

We retain your personal information for no longer than is necessary for the purposes for which it was collected and processed. We have established the following general retention periods:

  • Account Information: We retain your account information (e.g., name, email, subscription status) for as long as your account is active. If you delete your account, this information will be deleted or fully anonymized within 90 days, subject to our legal obligations.
  • Streaming & Viewing History: This data is retained for the life of your account to power recommendation features and for internal analytics. Upon account deletion, it will be anonymized or deleted.
  • Transaction Information: Records of payments and subscriptions are retained for 7 years to comply with financial, tax, and audit regulations.
  • Usage and Analytics Data: Automatically collected data used for analytics is typically retained in an identifiable form for up to 24 months.
  • Customer Support Communications: Records of your communications with our support team are retained for up to 5 years after the issue is resolved to maintain a record of our interactions and for training purposes.
  • Legal Obligations: We may retain certain information for longer periods if required to comply with a legal obligation, resolve disputes, or enforce our agreements.

10. International Data Transfers

We are based in the United States. The personal information that we collect is processed in the United States. If you are accessing our Services from outside the United States, please be aware that your personal information will be transferred to, stored, and processed in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world.

For transfers of personal information from the European Economic Area (EEA), the United Kingdom (UK), or Switzerland to the United States, we rely on appropriate legal transfer mechanisms. When transferring data to our service providers who are self-certified, we rely on the EU-U.S. Data Privacy Framework (DPF), the UK Extension to the DPF, and the Swiss-U.S. DPF. For other transfers, we may rely on the European Commission's Standard Contractual Clauses (SCCs) or other lawful transfer mechanisms.

11. Device Permissions

To provide certain features within our App, we may ask for your permission to access data from your device. We will only access this data with your explicit, in-app consent, which you can withdraw at any time through your device's settings. Below are the permissions the App may request and why we need them.

12. Your Rights and Choices

We strive to provide you with choices regarding the personal information you provide to us. Depending on your jurisdiction, you may have the right to access, correct, delete, or opt-out of the sale or sharing of your personal information.

12.1 Account Deletion

Consistent with the rules of the Apple App Store and Google Play Store, you have the right to delete your account at any time. You can initiate account deletion directly within the App by navigating to Settings > Account > Delete Account. Initiating deletion will deactivate your account and begin the process of erasing your personal information as described in our "Data Retention" section. Please note that deleting the App does not delete your account.

13. Keeping Your Personal Information Secure

We have implemented and maintain reasonable technical and organizational security measures designed to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These measures include, for example, data encryption, access controls, and regular security assessments.

14. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by logging into the Services and adjusting your user preferences in your account profile.
  • Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third parties' products or services, you can opt-out by logging into the Services and adjusting your user preferences in your account profile. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by logging into the Services and adjusting your user preferences in your account profile.

Residents of certain states, such as California, Nevada, Colorado, Connecticut, Virginia, and Utah may have additional personal information rights and choices. Please see Your State Privacy Rights for more information.

15. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Services and visiting your account profile page.

You may also send us an email at privacy@cheratv.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account.

16. Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to privacy@cheratv.com.

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

To exercise any of these rights, or to appeal a decision regarding a consumer rights request, please send an email to privacy@cheratv.com with "Appeal of Rights Request" in the subject line.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out right may submit an email to privacy@cheratv.com.

17. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk.

18. Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will notify you by email to the primary email address specified in your account and/or through a notice on the Services home page or via an in-app notification. The date the privacy policy was last revised is identified at the top of the page.

If you choose to contact us, you will need to provide us with enough information to identify you, proof of your identity and address, and a description of what right you want to exercise and the information to which your request relates.

20. How to File a GDPR Complaint

We hope that we can resolve any query or concern you raise about our use of your information.

The General Data Protection Regulation also gives you right to lodge a complaint with a supervisory authority, in the European Union (or European Economic Area) state where you work, normally live, or where any alleged infringement of data protection laws occurred.
